RAEFORD, NC – Tim D’Annunzio, Republican candidate for Congress in North Carolina’s 8th district, yesterday took legal action against opponent Harold Johnson after his continued remarks and advertisements have knowingly and deliberately spread lies, innuendos, and false statements.
“I’m not going to take these attacks on my character and family lightly,” Tim said. “The Republican establishment has gone through admittedly messy divorce records from over 15 years ago in an effort to smear my name and elect their candidate of choice, Harold Johnson.”
The lawsuit filed today maintains claims against Harold Johnson for defamation and for violations of the provisions of the North Carolina election laws which make it illegal to publish information about a candidate in a primary or election, knowing such statements to be false or in reckless disregard of the truth or falsity of the declaration which is intended to influence the primary or election.
In addition, a discovery was made by the Tim D’Annunzio campaign that Time Warner Cable was not allowing equal access to all candidates. Sales representatives allowed Harold Johnson to run more ads than the number allowed for D’Annunzio.
E-mails from Time Warner Cable, compared with Harold Johnson’s public ad buy, show that Tim was only permitted to purchase six ads during the 10am-6pm time slot on Fox News. Harold Johnson was permitted to buy eight during the same slot.
Ironically, Tom Fetzer’s wife Kate Spina is employed in cable media sales at Time Warner. Tom Fetzer has publicly endorsed Harold Johnson.

Tim D’Annunzio: Setting the Record Straight
The attacks by the media, Republican establishment, and his opponent Harold Johnson have been orchestrated to derail the campaign of Tim D’Annunzio. Tim is setting the record straight and facing his attackers head on – by proving these accusations wrong, one at a time.

Myth #1: Tim D’Annunzio is a “religious zealot” who believes he found the Ark of the Covenant, that he is the Messiah, and that God is going to drop a pyramid on Greenland.
Fact: It’s no secret that Tim is a born-again Christian. When his life seemed to be falling apart, Tim turned to to Christ and began to study the Bible. As a Christian, he has interpreted God’s word as written in the Bible to apply to the modern day. Tim believes God has a plan for his life, just as He does for all Christians. For this, Tim’s religious views have been attacked and misinterpreted by the liberal news media.
Myth #2: Tim is a drug addict with a criminal past.
Fact: Tim had a troubled upbringing. He escaped a culture of gangs and drugs by joining the military and moving to the Ft. Bragg area, where he’s lived for over 30 years. Myth #3: Tim was dishonorably discharged from the military.

Myth #4: Tim didn’t pay child support for his three children.
Fact: When Tim was starting his business, he was living below the poverty line, and lived modestly with his family in a doublewide trailer. Child support was set higher than the income he was making at the time. He was making virtually no money for almost two years and was unable to contribute full payment at times to the support of his children. Tim went on to build and grow a manufacturing/sewing company, and he held two patents to which made his product “one of a kind.” With much success, Tim sold his self-made business for $30 million. Three of his adult children now work for his company and live nearby in Raeford.
Myth #5: Tim is a “loose cannon” who can’t control his temper.
Fact: Tim is a family man, married to his wife Colleen for almost 15 years, and has 6 children. As proven by overwhelming number of votes he received from those who know him in his hometown of Raeford, and nearby in Fayetteville, Tim is a successful businessman who would not be where he is today without discipline, hard work, and a clear head. In the parts of the district where Tim is not as well known, the media has portrayed him in a negative light.
Myth #6: Tim D’Annunzio didn’t pay payroll taxes on his employees and had a tax lien against his company.
Fact: Tim was only part owner in Paraclete Armor and Equipment. When he bought out his partners, he assumed the tax lien and promptly paid it off. He has always been current with all taxes.
Tim is a man who didn’t have any opportunities handed to him. He has worked for everything that he has and is thankful to God for it. You can count on one thing for certain – Tim will tell you the truth just as he has from day one.

“I want to thank you all for coming today for this important announcement. I’m joined here by my family – my wife Colleen, my son John, his wife Michelle and my granddaughter Addison, my son Josh, and my daughter Sarah. I’m blessed to have such a wonderful family, and I’ve instilled in my children the values of hard work and beliefs in God and our country.
“With less than a month left until the runoff election between myself and Harold Johnson, I’ve made a personal decision. I’m going to sponsor a car in this Saturday’s NASCAR race at Charlotte Motor Speedway. Number 40, Mike Bliss, who was last year’s winner of this race, will be driving the Tim D’Annunzio for Congress car.
“I’m sponsoring this car to put my campaign in high gear. I understand the importance of the racing industry here in Cabarrus County, and it’s an industry that provides jobs for so many. From the mechanics who work on the cars in the pits, to those employed by the speedway, to neighboring businesses who benefit from the one hundred thousand plus spectators that pack the stands.

RAEFORD, NC – Tim D’Annunzio, Republican candidate for Congress in the 8th district, today questioned Obama Administration officials who have put American financial resources at the disposal of European countries who are bailing out debt-ridden Greece.
The United States is a participant in the International Monetary Fund, which has agreed to work with the European Union to help countries that come under debt duress.
“Bailouts didn’t work in this country, and they aren’t going to work in the European Union,” Tim D’Annunzio said. “The only result of a bailout is to delay consequences for some future time. They increase the severity of the eventual consequences, and at the same time are substitutions for real reform and real solutions.”
The IMF has pledged a one-third share of the 750 billion-euro ($952 billion) rescue package—typical of the fund’s arrangements with central banks in such cases. The United States would be responsible for 17 percent, or $54 billion – the most of any country contributing to the IMF.
“These types of policies here and in the EU border on gross negligence and should be repudiated every time they are proposed. And that doesn’t even mention the obvious – we don’t have the money and we can’t afford any further debt.”

Harold Johnson, second place runner-up in North Carolina’s 8th district Republican primary, has challenged winner Tim D’Annunzio to a runoff election. Tim received nearly 37% of the vote, and beat Mr. Johnson by nearly 1,000 votes.
According to the Charlotte Observer, the last statewide runoff in 2008 resulted in a voter turnout of less than 2 percent.
Turnout in Mecklenburg County was so low – half of 1 percent – that each vote cost taxpayers $121.
At a time when North Carolina is facing budget shortfalls and families are forced to make tough choices, Harold Johnson has no problem spending taxpayers’ money. If he makes decisions like this now, what will he do with your money when elected?
“It seems to me it’s pretty hard to justify runoffs given the very low voter participation,” says Michael Crowell, a professor at the UNC School of Government. “It seldom changes the outcome, and the winner of the runoff usually has fewer votes than most of the people who ran in the first primary.” (charlotte observer, 5/9/2010)

RAEFORD – Tim D’Annunzio, Republican candidate for Congress in the 8th district, today received the highest number of votes in the 8th district Republican primary, and faces Harold Johnson in a runoff on June 22. Tim received 37% of the vote, and released the following statement:
“I first of all would like to thank the voters of the 8th district who cast their ballots today in favor of a return to a limited constitutional government. Without your support over these past 9 months, I would not be within striking distance of Larry Kissell.
“While I did win a majority of the vote, the fact that I did not reach the 40% threshold leads us to a runoff election on June 22. I will take the runoff election as an opportunity to continue to show the voters of the 8th district that I am the only conservative candidate in this race.
“Across the country, true Republicans face attacks from their less-than-conservative opponents, and I will continue to be a champion of conservative, constitutional values. I challenge Harold Johnson to a series of debates over the next six weeks so our differences can be clear for the voters.
“My message throughout this campaign has been consistent. The level of spending by our government is unsustainable, and puts us on a path to bankruptcy. We must bring government spending back under control by reducing its size and doing away with programs and departments that are unconstitutional.

RAEFORD, NC – Tim D’Annunzio, Republican candidate for Congress in the 8th district, today spoke out in support of a recent bill signed into law in Arizona that enforces immigration laws and secures its border with Mexico.
Governor Jan Brewer signed a bill into law last week that allows for law enforcement to check the identification of anyone suspected of being in the United States illegally.
“I support Arizona’s right to secure its borders and its population against criminals breaking immigration law,” Tim D’Annunzio said.
“President Obama should do his job and enforce the law, not intervene on the side of law breakers and against states rights. He is agitating the situation with inflammatory rhetoric and irresponsible accusations against those who only want to secure their life, liberty and property.
“If elected, I pledge to enforce and strengthen our current immigration laws. Illegal immigration in itself is a crime, and we should not wait for these criminals to commit additional unlawful activities before we take action.”
RAEFORD, NC – Tim D’Annunzio, Republican candidate for Congress in the 8th district, today received the endorsement of two separate chapters of We the People.
We the People NC of Cabarrus County and We the People of the Sandhills both announced their support today, and the Cabarrus County chapter held a formal endorsement announcement outside the Government Center in Concord.
“It is our desire to return to the fundamental basis of the Founding Fathers of sending citizen legislators, not professional politicians to Congress,” said Michael Hyers, spokesperson for We the People of the Sandhills. “Tim D’Annunzio embodies everything we are looking for in a Representative – someone who will go to Washington to restore the foundations of our Constitution and fight for a return to limited government.”
In Concord, the endorsement announcement by We the People NC of Cabarrus County was attended by supporters and media.
“We need someone who will stand up to the arrogance of the Washington DC political establishment, to return the Federal government to its constitutional responsibilities and to crush socialism. We need men like Tim D’Annunzio who understand that our republic is hanging by a thread and there is little time to lose,” said Michael Kelly of We the People NC of Cabarrus County.
“We the People NC endorses Tim D’Annunzio for the congressional race in the 8th District of NC because he has proven he will defend our right to life, liberty and private property.”

RAEFORD, NC – Tim D’Annunzio, Republican candidate for Congress in the 8th district, today spoke out in opposition of a recent court ruling declaring the National Day of Prayer unconstitutional.
The case was brought by the Freedom From Religion Foundation. A U.S. District Judge ruled that the holiday violated the “Establishment Clause” of the First Amendment of the Constitution. The Judge said she relied on Case Law as the basis for her decision.
“What I see in this is bad law being justified by previous bad law. When I talk about returning to the foundations this is a perfect example of why,” Tim D’Annunzio said.
“Is the National Day of Prayer a day that requires everyone to pray in an established manner or does it encourage, anyone who wishes to, free exercise their individual religion? Is it a celebration of the First Amendment or a restriction of it?”
“I look back to Article 3 of the Northwest Ordinance, passed in 1787, which states, ‘Religion, morality, and knowledge, being necessary to good government and the happiness of mankind, schools and the means of education shall forever be encouraged.’”
“Our government, academia and the press have been infiltrated by those who are the antithesis of our Constitution’s original intent. We must return to the foundations, and nothing other than the Constitution itself and the explanations and examples of the founders should be considered in interpreting and justifying current or new law.”
National Day of Prayer is celebrated each year on May 6.
